Registration of Birth / Declaration of Parentage
Birth Registrations
In Ontario, a child’s birth can be registered online under the following circumstances:
• If the child is born to you and your spouse, where the child was conceived through assisted reproduction or insemination by sperm donor;
• If you are part of a pre-conception parentage agreement for the child and there are no more than four parents;
• Where the child’s birth involves a surrogate, if you had a surrogacy agreement before the child is conceived, and the surrogate agrees to give up parental rights no earlier than seven (7) days after the child is born.
Please note that if the child’s birth involves a surrogate, certain forms (Statutory Declaration by Surrogate, and Statutory Declaration by Intended Parents) must be mailed to the Office of the Registrar General in order to complete your child’s birth registration.
For information on registering a birth with more than four parents, or for more information on registering a birth with a surrogacy agreement or parents using inclusive titles, call the Government of Ontario at 1-800-461-2156. Otherwise, Inspire Law is only a phone call away.
What is a declaration of parentage?
A declaration of parentage is a legal document that establishes the legal parentage of a child. Once a declaration of parentage is established, it has legal implications for both the parent(s) and child, providing clarity and certainty regarding parental rights and obligations.
Fortunately, declarations of parentage are no longer required in most circumstances. Where they are required, however, in order to register your child’s birth, Inspire Law is available to assist.
